Which listings am I allowed to post?

The 'Marketplace' section allows neighbours to buy, sell, trade or give away goods in a friendly and local manner. To ensure a safe environment and comply with applicable legislation, we ask all users to respect the following guidelines.


🚫 Prohibited listings

Certain categories of items may not be offered or requested on Hoplr:

  • Medicines: It is not permitted to offer or request medicines, whether prescription or not. This also applies to homeopathic remedies, herbal medicines and veterinary medicines.
  • Animals: The sale or giving away of animals via Hoplr is not allowed.
  • Tobacco products: The sale or exchange of tobacco or related products is strictly prohibited.
  • Illegal items: The sale or transfer of items prohibited by law is not allowed.

✅ Allowed listings

Certain products may be offered in the 'Marketplace' section:

  • Dietary supplements: Vitamins and other dietary supplements are not subject to medicine legislation and may therefore be offered or requested.
  • Second-hand goods: Furniture, clothing, electronic devices and other consumer goods may be offered.

🍽️ Sale of food

Members of a platform – even if the platform is focused on neighbourly assistance – are considered operators like any others. This means they must be registered with the competent agency, unless they meet the legal conditions for exemption.

Exemption according to Article 2, §2, 1°

According to the law, the obligation for registration, authorisation or recognition does not apply to operators who:

  • act non-profit or in the general interest, and
  • operate as associations or organisations carrying out an activity in the interest of their association or organisation,
  • a maximum of 5 times per year and for a total duration of no more than 10 days.

What does this mean in practice?

  • The exemption only applies to associations or organisations without a profit motive, even though the activity itself may be profitable.
  • Individual persons do not fall under this exemption.

Examples

Not exempt: A student selling waffles to finance her own end-of-year trip, since she is not an association or organisation.
Exempt: A school or scout association selling waffles once to partly fund a camp, as long as this falls within the limits of the law.

In all other cases, registration, authorisation or recognition must be applied for.


📜 Compliance with legislation

Hoplr users must comply with the applicable laws and regulations in their country. Since Hoplr operates in multiple countries, certain rules may vary depending on local legislation. We advise users to inform themselves about the applicable laws regarding the sale, exchange and giving away of certain items.

Hoplr reserves the right to remove listings that do not comply with these guidelines or are contrary to the law.
