Which listings am I allowed to post?

The 'Marketplace' section allows neighbours to buy, sell, swap, or give away items in a friendly and local way. To ensure a safe environment and comply with applicable laws, we ask all users to follow these guidelines.


🚫 Prohibited Listings

Certain categories of items may not be offered or requested on Hoplr:

  • Medicines: It is not allowed to offer or request medicines, whether they are prescription-based or not. This also applies to homeopathic remedies, herbal medicines, and veterinary drugs.
  • Animals: The sale or giveaway of animals via Hoplr is not permitted.
  • Tobacco Products: The sale or exchange of tobacco or related products is strictly prohibited.
  • Illegal Items: The sale or transfer of items that are prohibited by law is not allowed.

✅ Permitted Listings

Certain products are allowed to be offered in the 'Marketplace' section:

  • Dietary Supplements: Vitamins and other dietary supplements are not covered by medicine laws and may be offered or requested.
  • Secondhand Goods: Furniture, clothing, electronic devices, and other consumer goods can be listed.

🍽️ Sale of Food

Members of a platform – even if the platform is focused on neighbourly help – are considered operators like any other. This means they must be registered with the relevant agency unless they meet the legal exemption criteria.

Exemption under Article 2, §2, 1°

According to the law, the obligation to register, obtain authorisation, or recognition does not apply to operators who:

  • act without profit motive or in the public interest, and
  • operate as associations or organisations carrying out an activity in the interest of their association or organisation,
  • a maximum of 5 times per year and for a total duration of no more than 10 days.

What does this mean in practice?

  • The exemption applies only to associations or non-profit organisations, even if the activity itself may generate profit.
  • Individuals are not covered by this exemption.

Examples

Not exempt: A student selling waffles to fund her own end-of-year trip, as she is not an association or organisation.
Exempt: A school or scout group selling waffles as a one-off fundraiser to help finance a camp, as long as this falls within the legal limits.

In all other cases, registration, authorisation, or recognition must be obtained.

Hoplr users must comply with the applicable laws and regulations in their country. Since Hoplr operates in multiple countries, certain rules may vary depending on local legislation. We recommend users familiarize themselves with the relevant laws regarding the sale, exchange, and giveaway of specific items.

Hoplr reserves the right to remove listings that do not comply with these guidelines or that violate the law.
